Term and Conditions

1. The contract entered into between Edilceram Srl and the Customer shall be deemed concluded with the acceptance of the order by the selling company. This acceptance shall be deemed tacit, unless otherwise communicated in any manner to the Customer. By placing an order in the various ways provided, the Customer declares that he/she has read all the information provided to him/her during the purchase procedure, and that he/she fully accepts the general conditions and payment conditions transcribed below.
2. If the Customer is a consumer, once the online purchase procedure has been completed, he/she shall print or save an electronic copy and in any case keep these general terms and conditions of sale, in accordance with the provisions of Articles 3 and 4 of Legislative Decree No. 185/1999 on distance sales, and subsequent additions and amendments.
3. The customer shall not be entitled to claim compensation or indemnity for damages, nor shall contractual or extra-contractual liability claims be possible for direct or indirect damages caused by the total or partial non-acceptance of an order.

The Customer may purchase the products present in the electronic catalogue of Edilceram Srl at the time of placing the order and viewable online at (URL) edilceramdesign.it as described in the relevant information sheets. It is understood that the image accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics but may differ in terms of features, colour, size, accessory products in the picture. All purchase support information (Glossary, Purchase Guide, etc.) is intended as mere generic information material, not referring to the real characteristics of a single product.
2. Correct receipt of the order shall be confirmed by Edilceram Srl by means of an e-mail reply sent to the e-mail address communicated by the Customer. This confirmation message shall contain the Date and Time of execution of the order and a ‘Customer Order Number’, to be used in any further communication with Edilceram Srl. The message shall reproduce all the data entered by the Customer, who undertakes to verify the correctness thereof and to promptly communicate any corrections, according to the procedures described in this document within 24 hours.

1. In the event of non-execution of the order due to the unavailability, even temporary, of the goods, Edilceram Srl, within 3/5 working days from the day after the day on which the Customer has sent the order through the edilceramdesign.it website, shall inform the Customer and provide for the reimbursement of any sums already paid for the payment of the goods.
2. In the event of cancellation of the order, either by the Customer or by Edilceram Srl, the relevant amount shall be credited back to the payment method used (PayPal, credit card through PayPal, Stripe or PayPlug). Re-crediting times depend exclusively on PayPal, the banking system and the payment gateways used, and Edilceram Srl is not responsible for any delays or damages caused by these entities.

4. The form of payment Advance Transfer is possible on all catalogue items. Any limitations are clearly highlighted in the shopping cart. In the event of payment by bank transfer in advance, the items ordered by the Customer shall be held until receipt of proof of the bank transfer, to be sent to Edilceram Srl (e-mail) no later than 3 working days from the date of order acceptance. The dispatch of what has been ordered shall take place only upon actual crediting of the sum due on the Edilceram Srl current account, which must take place within 7 working days from the date of acceptance of the  order*
   
   

   The reason for the bank transfer must state:
   the order reference number;
   the date the order was placed;
   the name and surname of the person placing the order.

   *In the event of cancellation of the order, either by the Customer or by Edilceram Srl, the amount shall be credited back to the Customer's bank account. Re-crediting times depend on the banking system and Edilceram Srl is not responsible for any delays or damages caused by these entities.

   
   
5. Bank transfer to current account in the name of Edilceram Srl.
   Therefore, for all the above payment methods, the refund will be made on the same means of payment with which the order was placed.

For each order placed on the edilceramdesign.it website, Edilceram Srl issues a fiscal invoice of the material shipped, sending it by e-mail or by mail to the holder of the order, pursuant to art 14 D.P.R. 445/2000 and DL 52/2004. For the issuance of the invoice, the information provided by the Customer at the time of the order. No change of document (data) will be possible, after the issuance of the same

7. Delivery charges shown on each product sheet are the responsibility of the Customer. For the islands (MATRIX RATE) it is necessary to establish an ad hoc shipping cost. The payment of the goods by the Customer will be made using the method chosen when placing the order. Duties and retainage are the responsibility of the customer.
   Shipping times start upon receipt of the money by the customer.
8. Edilceram Srl cannot be held responsible for any delays in order fulfillment or delivery of ordered products. This includes delays due to unusable road conditions, logistical problems, or other circumstances beyond our control. Under no circumstances will Edilceram Srl be liable for any damages resulting from such delays.
   Delivery of products is at street level and does not include assembly or porterage services. The Customer is required to verify:
   • That the number of packages delivered corresponds to what is indicated in the transport document.
   • That the packaging is intact and undamaged, including sealing materials such as adhesive tape or metal strapping.
9. In case of failure to collect within 5 working days of the material in stock at the warehouses of the courier due to repeated inability to deliver to the address specified by the Customer when placing the order, will be charged storage costs, and / or other taxes.

1. Pursuant to art. 64 of Legislative Decree No. 206/2005, as amended and supplemented, if the customer is a consumer, he/she has the right to withdraw from the purchase contract for any reason whatsoever, without the need to provide explanations and without any penalty, without prejudice to what is indicated in point 20 below.
2. To exercise this right, the customer must retain the original packaging of the product sold and send Edilceram Srl a notice by form within fourteen (14) days from the date of receipt of the goods. 
   
   Once we receive the above notice of withdrawal, Edilceram Srl will quickly communicate to the Customer instructions on how to return the goods, which must be received within fourteen (14) days of authorization.
3. However, the right of withdrawal is subject to the following conditions:- il diritto si applica al prodotto acquistato nella sua interezza; non è possibile esercitare recesso solamente su parte del prodotto acquistato;
   - the purchased goods must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original packaging, we recommend, when possible, to put it in a second box; in accordance with the law, shipping costs related to the return of the goods are borne by the Customer as duties, shipping and / or miscellaneous and possible;
   - the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer; in case of damage to the goods, Edilceram Srl will notify the customer of the incident (within 5 working days of receipt of the goods in their warehouses), to enable him to file a timely complaint against the carrier of his choice and obtain reimbursement of the value of the asset (if insured, which we recommend); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal, without any refund guaranteed;
   -Edilceram Srl is not liable in any way for damage or theft/loss of returned goods. Upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the packaging and / or the original packaging are damaged, Edilceram Srl will deduct from the refund due a percentage, up to a maximum of 20% of the same, as a contribution to the costs of restoration.
   The goods will be held for 30 days at our warehouse free of charge, from the 31st day a storage fee of 10€(ten euro) per day will be charged.
4. Without prejudice to any repair costs for ascertained damage to the original packaging, Edilceram Srl will refund the customer the full amount already paid, as quickly as possible and in any case within fourteen (14) days from the date on which the communication of the exercise of the right of withdrawal by the consumer has arrived. The refund will be made through the procedure of transferring the amount charged to the Credit Card or by Bank Transfer. In any case, it will be the Customer's responsibility to promptly provide the necessary and useful data to obtain the refund.
5. The right of withdrawal lapses completely in case of lack of integrity of the goods (packaging and / or content) if Edilceram Srl finds:
   
   • The absence of the original outer packaging and/or inner packaging.
   • The lack of essential product items (accessories, manuals, parts, etc.).
   • Damage to the product due to causes other than transportation.
   • Miscellaneous.
     In case of forfeiture of the right of withdrawal, Edilceram will return the purchased goods to the sender, charging the same shipping costs.

5.2 If custom merchandise arrives damaged, the consumer is still entitled to a replacement or refund of the product. It is important to document the damage with photos or video and contact the seller immediately to report the problem. This must all be signed with reservations.

5.3 Goods at the time of laying or mopping can no longer be disputed, unless there is hidden damage.

1. All products sold by Edilceram Srl are covered by the manufacturer's conventional warranty and 24-month warranty for conformity defects, in accordance with DL 24/02. To benefit from warranty service, the Customer must keep the invoice or receipt that he/she will receive by e-mail.
2. The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Service Center, the defect turns out not to be covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and restoration required by the Authorized Service Center, as well as transportation costs, if incurred by Edilceram Srl 
3. The 24-month warranty in accordance with DL 24/02 applies to the product that presents a conformity defect, provided that the product itself is used correctly, in accordance with its intended use and as provided in the attached technical documentation. This warranty is reserved for the private Consumer. In case of lack of conformity, Edilceram Srl provides, without cost to the Customer, the restoration of conformity of the product by repair / replacement, until the termination of the contract. If, following intervention by an Authorized Service Center, the defect does not result as a lack of conformity pursuant to DL 24/02, the Customer will be charged for any costs of verification and restoration required by the Authorized Service, as well as the costs of transportation if incurred by Edilceram Srl
4. Replacements in case of DOA (Dead On Arrival: product not working on delivery) occur only if expressly provided for by the manufacturer. The timing of replacement or possible repair of the product depends solely on the manufacturer's policies.
5. In the event that, for any reason, is unable to return to its customer a product under warranty (restored or replaced), Edilceram Srl may proceed at its own discretion to refund the full amount paid or replace it with a product of equal or superior characteristics.
6. No damages can be claimed from Edilceram Srl for any delays in making repairs or replacements or cancellation of the requested item.
7. In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, etc...).

The personal data requested when placing the order are collected and processed in order to meet the expressed requirements of the Customer and will not under any circumstances and for any reason be transferred to third parties. Edilceram Srl guarantees its customers compliance with the regulations on the processing of personal data, governed by the Privacy Code referred to in DL 196 of 30.06.03.

For everything herein not expressly provided for and not provided for, the parties make explicit reference to national and EU, ordinary and special regulations on buying and selling, consumer rights and e-commerce.
The sales contract between the Customer and Edilceram Srl is concluded in Italy and governed by Italian Law. For the solution of civil and criminal disputes arising from the conclusion of this contract of sale at a distance, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Bari.
